Terms of service

This is the agreement between Qgress and the business that opens a queue on it. It is written to be read once, in full, by the person who signs up.

Who this agreement is between

Qgress is based in Pune, Maharashtra 412101, India. In these terms, we and Qgress mean the business that runs it, and you means the business that holds the Qgress account.

By opening an account you accept these terms on behalf of your business, and you confirm you are at least 18 and authorised to do so.

What Qgress is

Qgress is queue software. You create a branch, open a queue and display a QR code. Your customers scan it, take a token and wait wherever they like. Your staff call the next customer from the console, and the customer's phone tells them when to come back.

We provide the software only. We do not provide the service your customer is waiting for, we do not employ your staff, and we take no part in the transaction between you and your customer.

Opening an account

Give us details that are true, and keep them current. Your sign-in belongs to you alone: you are responsible for everything done through your account and through the staff logins you create.

Tell us promptly if you think someone else has your credentials.

Verifying your business

We may ask for documents that show the business is real and is yours, and some features stay closed until we have them. We may decline to verify a business, or withdraw verification, where the documents do not support the claim being made.

Your customers, and what you ask of them

You decide what your join screen asks for. A customer can take a token with no name and no phone number at all. If you do collect a name or a number, you are the one who must have a reason for it and must be able to explain that reason to the customer.

We process that information on your instructions in order to run your queue, and for nothing else. The privacy policy sets out how, where it is stored, and how long it survives.

Anything you send to your customers through Qgress, including broadcasts and offer content, is yours. Send only what they would expect from a queue they joined.

What you may not do

Plans, fees and tax

Current plans and prices are on the pricing page. Paid plans are charged in Indian rupees, in advance, for the billing period you choose, through our payment gateway Razorpay. We do not see or store your card details.

Prices exclude GST, which is added where it applies. The free plan is free and stays within the limits published on the pricing page.

If a payment fails we mark the account past due and retry. Paid features stop while an account is past due, and the account drops to the free plan if it stays unpaid. Your queues and history are not deleted for non-payment.

Changes to plans, features and prices

The product is under active development, so features are added, changed and occasionally withdrawn. If we withdraw something material from a plan you are paying for, we will tell you by email first.

We may change prices. A change applies to you from your next renewal, never inside a period you have already paid for, and we will give at least 30 days' notice by email.

Availability

We work to keep Qgress running during your opening hours, and it is built so that a customer who has already taken a token keeps their place even if their phone loses signal. We do not promise uninterrupted service, and there is no service level agreement on self-serve plans.

We may take the service down for maintenance. Where we can plan it, we plan it outside Indian business hours.

Your data stays yours

You own the data you and your customers put into Qgress. You grant us permission to host, process and back it up so that we can run the service for you, and for nothing else. We do not sell it and we do not use one business's data to advise another, with one exception: figures pooled across many businesses, with nothing in them that identifies a business or a person, may be used to improve the product and to publish industry averages.

You can export your data from the console at any time while the account is open.

Ending the agreement

You can cancel at any time from the console. Cancellation and what happens to money already paid are covered by the refunds and cancellation policy.

We may suspend or close an account if payment stays unpaid, if these terms are broken, if the account is being used in a way that puts other customers or the service at risk, or if the law requires it. Except where a suspension has to be immediate, we will tell you what is wrong and give you a chance to put it right.

When an account closes, we delete or anonymise its data within 90 days, other than records we are required to keep for tax and audit purposes.

Liability

Qgress is provided as it is. To the fullest extent the law allows, we are not liable for lost profits, lost custom, lost goodwill, or for anything your customers do or fail to do.

Our total liability to you for all claims in any 12 month period is limited to the fees you paid us in the three months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.

Indemnity

You will cover us against claims brought by your customers, your staff or a regulator that arise from how you used Qgress, including what you chose to collect from your customers and what you sent them.

Changes to these terms

We update this page when the terms change, and the date at the top always reflects the current version. If a change materially affects you we will email the account owner before it takes effect. Continuing to use Qgress after that means you accept the new terms.

Governing law

These terms are governed by the laws of India. The courts at Pune have exclusive jurisdiction over any dispute, and we both agree to try to settle it in writing first.
